Eco nature - Farm cottages
Generalities
These general conditions of sale are concluded between,
on the one hand the SASU “Eco nature” whose head office is located 366 Gorgelian, 33930 Vendays-Montalivet
R.C.S Bordeaux : 887 831 634, above-mentioned as “THE OWNER” and on the other hand,
people wishing to rent a gîte offered by the SASU “Eco nature” hereinafter referred to as “THE TENANTS”.
This being stated, it is agreed as follows :
Article 1
This contract concerns the rental of gîtes located at 366 Gorgelian 33930 Vendays-Montalivet.
This is a small furnished house or mobile home.
Article 2 - Duration of stay
The tenant signing this contract concluded for a fixed period may not under any circumstances claim any right to remain in the premises at the end of the stay.
Article 3 - Contract conclusion
The reservation becomes effective once the tenant has signed copies of the contract and paid the amount of their reservation (in full or in 4 installments free of charge via PayPal or directly with the owner via their TPE). The second copy will be given to the tenant.
The rental concluded between the parties to this deed may not under any circumstances benefit, even partially, third parties, whether natural or legal persons, except with the written agreement of the owner. Any breach of this last paragraph would be likely to result in the immediate termination of the rental at the tenant's expense, with the rental income remaining permanently acquired by the owner.
Article 4 - Cancellation by the tenant
Any cancellation must be notified to the owner !
a) Cancellation before arrival at the premises
Any deposit remains with the owner. The latter may request the balance of the amount of the stay if the cancellation occurs less than 20 days before the scheduled date of entry into the premises.
If the tenant does not show up within 24 hours of the arrival date indicated on the reservation, this will become null and the owner will then be able to dispose of his gîte. The deposit will also remain with the owner who will request the balance of the rental.
b) If the stay is shortened, the rental price remains with the owner. No refunds will be made.
Article 5 - Cancellation by the owner
The owner pays the tenant the full amount paid in advance.
Article 6 - Arrival
The tenant must show up on the day specified in the time slot mentioned on the reservation.
In the event of late or delayed arrival, the tenant must notify the owner.
Article 7 - Settlement of the balance (if payment of a deposit via the TPE)
The balance of the rental will be payable upon entry into the premises.
Article 8 - State of play
An inventory is drawn up jointly and signed by the tenant and the owner or his representative upon arrival and departure from the gîte. This inventory constitutes the only reference in the event of a dispute concerning the inventory of fixtures.
Article 8 b - The breakage
If applicable, please report it during your stay. Immediately inform the owner of the incident and/or damage occurring in the rented premises, even if no apparent damage results.
The cleanliness of the accommodation upon the tenant's arrival must be noted in the inventory. Cleaning of the premises is the responsibility of the tenant during the rental period. When the tenant leaves, the gîte must be tidy and left in the same condition as when you arrived. If this is not the case, the end-of-stay cleaning will be the responsibility of the tenant of the gîte and will be invoiced.
The amount of any cleaning fees is mentioned when signing the rental contract. In the event of abnormal use of the premises, or exceptional soiling, the amount of the cleaning costs will be re-invoiced to the tenant.
Article 9 - Security deposit or surety
Upon arrival of the tenant, a security deposit of €180 by bank imprint is requested by the owner.
After the contradictory establishment of the exit inventory, this deposit is returned, less the cost of restoring the premises if damage is noted.
Any refund of the deposit will be effective within 8 days if the exit inventory is consistent with the entry inventory.
In the event of early departure (before the time mentioned in the contract) preventing the inventory from being drawn up on the day of the tenant's departure, The security deposit will be returned by the owner within a period not exceeding 10 days if the exit inventory is consistent with the entry inventory.
In the event that the exit inventory does not comply with the entry inventory, in other words if there is damage attributable to the tenant, The owner will release part of your security deposit within a maximum of 1 month or may keep this deposit in full and may claim from you, with supporting evidence, an additional sum depending on the damage noted.
Article 10 - Use of the premises
The tenant must ensure the peaceful nature of the rental and use it in accordance with the purpose of the premises.
Article 10 b - Terms of Use
The user agrees not to use the WI-FI service for illicit, prohibited or illegal purposes.
Article 11- Ability
This contract is established for a maximum capacity of people indicated at the time of booking. If the number of tenants exceeds the capacity, the owner may refuse the additional people. Any modification or termination of the contract will be charged to the tenant.
Article 12 - Animals
This contract specifies that no domestic animals can be accepted within the property. In the event of non-compliance with this clause by the tenant, the owner may refuse the stay. In this case, no refund will be made.
Article 13 - Insurance - Children
The tenant is responsible for all damages arising from his fault. It is required to be insured !
Tenants are responsible for their children.
Article 13 b - Prohibition - Children
It is forbidden to go beyond the barrier where the animals are.
Children must be supervised both on the playground and throughout the property.
The owner cannot be held responsible in the event of a problem related to your children.
Children are under the full responsibility of their parents and/or accompanying persons.
Article 14 - Payment of charges
Water and electricity charges are included in the rental price for normal use.
In the event of abnormal usage, charges may be re-invoiced to the tenant.
Article 15 - Disputes
In the event of a dispute, which cannot be the subject of an amicable agreement, the competent court will be that of the head office of Eco nature.
Any failure to comply with these rules will result in additional invoicing.
